1. Is ShoutCrowd membership necessary?

ShoutCrowd membership is necessary only if you want to join a street team, participate in ShoutCrowds' interactive activities such as becoming a street team member, posting messages on our message boards, qualifying for giveaways, sweepstakes and contests. However, you do not need to be a ShoutCrowd member to enjoy the website. Non-members can still surf part of the website, read the technology and music industry news, use our links, and more.

2. What kind of personal information does ShoutCrowd collect from members?

The kind of personal information we collect from you includes information like your name, postal mailing address, e-mail address, telephone number, age, birth date, gender, hobbies, interests, and of course, who your favorite artists are. Basically, the kind of information that lets ShoutCrowd, our clients, affiliates and partners know who is a member, how to communicate with you and what kind of things you might want to know about.

During registration we will ask you for your birth date, e-mail address, username and password. We will collect more personal information while you use our website like when you enter a ShoutCrowd sweepstakes or participate in one of our promotions (the type of information collected will vary according to the promotion-please see promotion guidelines for specific information). Likewise, if you contact us, we will probably keep a record of that correspondence.

In addition, if you sign up to be a street team member, ShoutCrowd will request additional information such as your opinion about an artist, project and/or album, how you promoted a particular project, whether the promotion was a success or failure, the feedback you obtained in a particular market as a result of a promotion, etc.

3. What is a "cookie" and what does ShoutCrowd do with them?

A cookie is a small data file that a website can write to your hard drive for internal reporting and record keeping purposes. Generally, ShoutCrowd uses cookies to measure activity on the website (how many people entered a sweepstakes or visited an area on the website). Cookies also allow us to make improvements and updates to the website based on which sweepstakes, promotions or subject areas are popular and which aren't. In addition, cookies allow ShoutCrowd to store and retrieve login information such as "remembering" your login name (even if you don't), identifying the web pages you visit. As part of offering and providing tailored and personal service, ShoutCrowd may use cookies to store and track information about you in order to send you bulletins that correspond to your interests.

We may match information obtained from cookies with data provided by you or collected by third parties and analyze this data in the aggregate (to learn broad statistics about our members) and individually (which page you visit the most). This information lets us further personalize our services to you. We also provide aggregate analysis of our users to prospective partners, advertisers, and other third parties. We do this to help us bring you first-rate, personalized services, free of charge.

You may occasionally get cookies from our advertisers or third party partners (as explained in Section 6) which is standard in the Internet industry. ShoutCrowd does not control these cookies, and these cookies are NOT subject to ShoutCrowd's privacy policy.

Remember that you can disable cookies on your computer by indicating that you do not want your computer to accept them in the preferences or options menus in your web browser.

4. What type of information does ShoutCrowd share with advertisers, sponsors or any other third parties?

Aggregated personal information is one type of information that ShoutCrowd may supply to third parties. In addition, our sponsors, partners or advertisers, may affix a link to their site or an option box within a ShoutCrowd sweepstakes, article or advertisement, whereby double-clicking will entitle you to "more information" or a "special offer" (or something of the like) and entitle them to your e-mail address or other information. It is important for you to note that any information you supply them by "opting in" this way is not subject to ShoutCrowd's privacy policy. This subject is further addressed in Section 7.

For example, we may tell our partners statistics like: 327 members are on Artist A's street team and 300 of those members received positive feedback in promoting Artist A's new single.

Record companies, music artists, publishers, promoters, retailers, managers or other such music industry folk ("our clients") hire ShoutCrowd to run street teams, mailing lists, fan clubs, and promotions for them or purchase software and your personal information from ShoutCrowd that allow them to run such street teams, mailing lists, fan clubs and promotions themselves (for more information about who ShoutCrowd is and what ShoutCrowd does-please see our Terms of Service).

If you join a street team you are automatically "OPTING IN" to allow ShoutCrowd to share your specific personal information as well as your division reports (division reports generally include information such as where a street team member posted fliers, who he or she spoke to at a particular retail outlet, what they had to say, etc.) with our music industry partners, affiliates and clients As such, our clients, affiliates and/or partners may contact you directly via email or otherwise.

EXAMPLE, if you sign up for the Hillary Duff street team, you will be asked contact info (shipping address, phone number, instant messenger name), level of education (and college/major/graduation date if in college), tastes (favorite bands, movies, stores, etc.), resume (optional) and that information will automatically go into the Hillary Duff street team database as will information about the promotions you run. Hillary Duff, her record company, manager or some other music industry professional may then log in to the ShoutCrowd Professional Site and view, analyze and otherwise use the information in the database to market Hillary Duff. Our clients, affiliates and/or partners may choose to contact you directly to specifically request information about the promotion or to send you newsletters, music, additional materials and other such correspondence related to the promotions you participate in.

ShoutCrowd will also disclose your personal information if it is necessary to protect your safety (or the safety of other ShoutCrowd's members), necessary to protect the security or integrity of the ShoutCrowd website or if we are required to do so by law.

5. What is aggregated information and what does ShoutCrowd do with it?

Aggregated information is personal information about you that we combine with personal information about everyone else that visits our website so that we know generally what you (and people like you) like about our website. When you visit ShoutCrowd, we collect some information about you either via cookies (explained in Section 3) or by asking you directly. We do this so that we can try to improve your overall experience when you visit us the next time. We also collect information about traffic patterns on the website, like how many people log on and at what times, which page is most frequently visited, and what type of artists you (and people like you) think are cool and interesting.

ShoutCrowd may also use your personal information to match content to your specific interests. ShoutCrowd will disclose, sell and/or rent your personally identifying information to a third party (including our advertisers, sponsors or other partners) (See Section 6 for more information).

6. What is personal identifying information and what does ShoutCrowd do with it?

Personal identifying information is specific information about you such as your name, age, address, hobbies, interests, preferences, etc.

As explained in Section 4, ShoutCrowd uses your personally identifying information to provide information about our members to our clients, affiliates and partners. It is also shared with other affiliated ShoutCrowd companies who may want to contact you about products, services or other offerings that may be of interest to you. Personal information is supplied when it is required by law or court order, to prevent against fraud and unauthorized transactions or under exigent circumstances to protect the personal safety or property of ShoutCrowd's other users, the public or ShoutCrowd itself.

7. What about the privacy policies and the use of cookies by links or advertisers?

When you visit the ShoutCrowd website you may be exposed to opportunities to link to other websites. Links can be from advertisers, content providers and/or partners who may use ShoutCrowd's logo and/or style because of a co-branding agreement but which may not follow the same privacy policies as ShoutCrowd. Advertisements can be placed on any page, in any configuration and in any region on the website. If you click on an advertisement or other link, you will be transported outside of ShoutCrowd's service to an entirely different website.

ShoutCrowd may contain links to other content providers' websites. These websites are also not under the control of ShoutCrowd and ShoutCrowd is not responsible for any content on a linked website nor for their privacy policies. Links provided by ShoutCrowd are for your convenience only and the inclusion of links does not mean that ShoutCrowd endorses the website.

It is important that you are careful about where you go on the web and advisable to check the terms of use and privacy policy of all the websites that you visit. If you are unsure as to where you are on the web, check the URL address. But remember if the URL is not www.shoutcrowd.com then ShoutCrowd cannot control how these other websites use cookies, collect and disclose personal information or implement their privacy policies.

For your own information and protection, keep in mind that whenever you voluntarily disclose personal information on message boards, through e-mail, or in chat areas, that information can be collected and used by others (and that there are people out there that collect and use it). For instance, if you post personal information in public places, you may receive unsolicited e-mail messages. Please think before you post any information online.

8. Children's Privacy Protection.

In order to insure that membership is not granted to a child, ShoutCrowd requires every potential member to enter his or her birth date before granting him or her membership to ShoutCrowd. ShoutCrowd does not knowingly collect information from children under 13. In the event that we are notified that a child under 13 has provided personal information, we will promptly delete all such information as soon as reasonably possible.

9. ShoutCrowd's Tips To Protect Your Personal Information.

Your ShoutCrowd profile is password-protected. The best way to keep your personal information secure is to not give your password to anyone. If you share your computer with other people, we recommend that you sign out of your ShoutCrowd account and close your browser window when you are done. Further, do not allow cookies to remember your ID name and password as "cookies" will enable someone else to sign on as you.

We make every effort to ensure that your information is secure on our system. Unfortunately, no data transmission over the Internet is guaranteed to be 100% secure. Consequently, we cannot guarantee the security of any information you transmit to us, and you do so at your own risk.

By using this website, you signify your assent to ShoutCrowd's privacy policy. If you do not agree to this policy, please do not use our website. ShoutCrowd's privacy policy might change from time to time and your continued visits to ShoutCrowd after such a change signifies that you agree to abide by the new privacy policy. If a change has been made to the ShoutCrowd privacy policy, ShoutCrowd will post a notice on the website for a limited time alerting you that a change has been made. However, it is your responsibility to check the privacy policy often to make sure that if it has changed you still assent to it. The privacy policy will always be dated as of the day the last revision was made for your convenience.
